GENERAL RULES – 30 DAYS IN BRAZIL CULTURAL CONTEST – THE KING OF ROLÊ
Entry Period: from Oct 12, 2019 to Mar 30, 2020.

1. SPONSOR: EMBRATUR – Brazilian Tourist Board, legal entity ruled by public law, registered in the National Registry of Legal Entities under No. 33.741.794/0001-01, and located in Setor Comercial Norte Q 3 - Asa Norte, Brasília - DF, 70740-610, Brazil.
2. THE CONTEST AND ITS ENTRY PERIOD:
2.1. The contest, called 30 DAYS IN BRAZIL FOR FREE, hereinafter referred to as CULTURAL CONTEST, aims to choose the person who provides the best answer to the question, “Why should I spend 30 days in Brazil for free?”
2.2. The CULTURAL CONTEST calls for the free and voluntary participation of entrants, and does not include any form of draws or payouts to PARTICIPANTS nor does it include any obligation to purchase any products, goods, rights, or services by the SPONSOR. The CONTEST is solely and exclusively a “Cultural Contest,” as described in Ordinance 422, by the Ministry of Finance, of July 2013. The CONTEST is therefore exempt from authorization or registration by SECAP (Department for the Evaluation of Public Policies, Planning, Energy, and Lottery) in the Ministry of Economy, according to Article N. 3 of Law No. 5,768/71.
2.2.1. The CONTEST will be bound, if applicable, by the content in Laws 8.666/93 and 5.768/71.
2.3. The entry period for the CONTEST will extend from Oct 12, 2019 to Mar 30, 2020.
2.4. The SPONSOR is solely responsible for the CONTEST, and there is no involvement whatsoever by the social media networks used in the process.
2.5. The SPONSOR accepts all the terms and conditions by the social media networks used in the process.
2.6. The SPONSOR guarantees the safety, integrity, and availability of the registration data by ENTRANTS outside the environment of the social media networks used.
2.7. The SPONSOR guarantees effective contingency that will ensure the continuation of the CONTEST until its conclusion, without detriment to ENTRANTS for any reason.
3.1. The CONTEST is open to individuals who are born foreigners residing ABROAD, owners of valid and public profiles in the social network INSTAGRAM (https://instagram.com/), and over 18 years of age at the time of entry.
3.2. The participation of partners, agents, employees and collaborators of the SPONSOR and other companies of the same economic group, affiliates, related companies, holdings, controlled companies, subsidiaries, companies having at least one common partner, employees of companies involved in the organization, broadcasting, or promotion of this CONTEST, and 1st degree relatives is prohibited.
3.3. All the material sent in for the CONTEST may be used by the SPONSOR in any type of media, with appropriate credits to the author and the project. As of this moment, the ENTRANTS hereby declare they are aware and agree to such assignment of rights for a period of 2 (two) years.
3.4. Only the ENTRANT who submits the video for this CONTEST will be considered the author. The ENTRANT is solely and exclusively responsible for obtaining the authorization to use the image of other people who are portrayed in the video.
3.5. Similarly, the ENTRANT is responsible for obtaining permission to use images, music, or any other third party media or tools used in his or her video.
3.6. At the moment of registration, the ENTRANT agrees to receive notices and other communications from the SPONSOR, or Brazilian Tourism partners, using the contact information provided.
4. HOW TO ENTER
4.1. In order to enter, individuals will need to:
4.1.1. Have a public profile on Instagram.
4.1.2. Follow the profile @visitbrasil on Instagram.
4.1.3. Follow the instructions on the CONTEST webpage, 30days4free.visitbrasil.com, in order to create and broadcast his or her video.
4.1.4. Have been born a foreigner to Brazil, and reside in another country.
4.1.5. Speak their native tongue.
4.2. The video entry must meet the following requirements:
4.2.1. Be created by the ENTRANTS themselves.
4.2.2. Not be offensive, immoral, or discriminatory in relation to nationality, gender, politics, race, religion, beliefs, age, or any other condition.
4.2.3. Not qualify as invasion of privacy of third parties or any other unlawful act.
4.2.4. Not qualify as a violation of third-party rights (including image rights.)
4.2.5. Not convey, incite, or encourage pornography, prostitution-related services, or the like, nor contain or imply obscene content or content contrary to good morals.
4.2.6. Not contain images that suggest or encourage acts that may threaten the audience’s health, safety, and life.
4.2.7. Be about the theme 30 DAYS IN BRAZIL FOR FREE (#30DAYSINBRAZIL4FREE).
4.3. The SPONSOR reserves the right to disqualify, at any time and at its own discretion, without the obligation to justify the reason for disqualification, ENTRANTS whose material does not comply with the conditions specified in this set of rules, such as:
4.3.1. Material which may be construed as unauthorized copying, a reproduction of other material in part or in whole, or material that may raise questions on who the author is.
4.3.2. Material containing inappropriate or offensive content, such as: obscene or profane images and words, malice, sexual and/or pornographic content, slander, defamation, threats, violence, unlawfulness, discrimination of any kind, prejudice towards religion and freedom of belief, content that includes subliminal data (messages, information, images), and content that may be interpreted as incitement to commit crimes.
4.3.3. Material which may endanger people´s health and safety.
4.3.4. Material containing political propaganda or broadcasting favorable opinions about political parties and/or candidates of any nation.
4.3.5. Material infringing or misusing the copyright, intellectual property, and/or trademark of third parties, including those of the SPONSOR.
4.3.6. Material that may cause physical, moral, and/or financial damage to the ENTRANTS themselves or to third parties, or that are in any way in disagreement with the objective of this CONTEST.
4.4. There is no limit to the number of entries per ENTRANT.
4.5. In case of suspected fraud, the ENTRANT may be asked, at any given time and even during the entry period of the CONTEST, to present his personal data, under the penalty of immediate disqualification thereof. Disqualification will occur in cases where the ENTRANT uses mechanical, robotic, or dishonest means to interfere with the result of the CONTEST.
4.6. The entry period will start on October 12, 2019 and close on March 30, 2020.
5. ENTRY ASSESSMENT
5.1. Winner selection will be the responsibility of the judging committee, appointed exclusively by the CONTEST SPONSOR. Decisions shall be final and no appeals will be accepted.
5.2. Assessment of the videos and the selection of the winner will be based on the following criteria:
5.2.3. Clarity and ability to communicate.
5.2.4. Assessment of ENTRANT’s Instagram profile.
5.2.5. Correct use of the phrase “What would 30 days in Brazil mean to me?” and use of the corresponding hashtag (#30daysinbrazil4free) at the bottom of the video screen.
5.3. If identical or similar photos or videos are posted containing the same main idea by different ENTRANTS, and one of them is the winner, the SPONSOR lets it be known that the photo or video posted FIRST will be taken into consideration.
5.4. At the end of the entry period for the CONTEST, the judging committee, appointed by the SPONSOR, will choose the 100 (one hundred) best entries, out of which one winner will be selected in the end.
5.5. The ENTRANTS included in the best 100 may be contacted to make their videos available for use in EMBRATUR’s social media networks, as a way to promote Brazil abroad.
6. WINNER ANNOUNCEMENT
6.1. The judging committee will assess all valid entries that come in until 11:59 pm on March 30, 2020.
6.2 The winner will be announced on April 15, 2020, by the @visitbrasil profile on INSTAGRAM.
6.3. The winner must confirm his participation by sending an email to email@example.com informing his or her contact details (name, phone number, email address, and home address).
6.4. In the event that any winner is disqualified or loses the right to receive the prize for any reason, or for non-manifestation within 72 hours of the winner announcement, the SPONSOR may award another candidate in accordance with the order of classification produced by the Judging Committee.
6.5. The winner of the CONTEST hereby authorizes the SPONSOR to disclose his or her image, name, and voice, free of charge, in appropriate media, together or separately. This disclosure authorization, still tied to the authorized plan, will be valid for up to 2 (two) years after the result of the cultural contest.
6.6. The winner of the CONTEST promises not to participate, at the end of the 30-day prize, in any promotional endeavor under any ties with any company or DMO (Destination Marketing Organization) that promotes tourist destinations (or tourism facilities in destinations) other than Brazil for 6 (six) months.
7. THE PRIZE
7.1. THE JUDGING COMMITTEE will select the best video according to the criteria listed under item 5.2. The winner will receive a trip, including tickets, accommodations, attractions, local support, and transfers pre-established in the itinerary proposed by the Brazilian Tourism Board.
7.2. The prize may not be converted into cash, nor may it be redeemed for other products or services.
7.3. The SPONSOR will not be responsible for travel expenses, papers, insurance, or extra expenses of any kind prior to the winner’s arrival in Brazil.
7.4. The WINNER must present a doctor’s certificate informing EMBRATUR about any pre-existing medical condition.
7.5. The WINNER must hire TRAVEL INSURANCE in order to receive the prize.
7.6. Any extra purchases or additional expenses not foreseen in the itinerary proposed by the SPONSOR are the responsibility of the winner.
7.7. The expected travel period is the second semester of 2020 and may be altered by EMBRATUR, provided the WINNER is notified up to 15 days in advance, except for reasons of force majeure.
7.8. The winner agrees to follow the itinerary proposed by the Brazilian Tourist Board, to tag their social media networks, and use the Campaign hashtag throughout the entire trip in Brazil.
7.9. The SPONSOR may change the itinerary at any time, without the need to justify their decision.
7.10. The SPONSOR will not be held responsible for any conduct of the WINNER during his stay in Brazil, which may be in violation of the law, safety regulations, or considered inadequate social conduct.
7.11. In case of public calamity, natural disasters, emergencies, or any other situations of force majeure or unforeseeable circumstances, EMBRATUR reserves the right, in the impossibility of offering the trip on the scheduled date, to cancel it temporarily or indefinitely, even if the WINNER has already been selected.
8. FINAL CONSIDERATIONS
8.1. All entries that do not meet the requirements listed under item 4 will be disqualified.
8.2. By registering for this CONTEST, ENTRANTS declare that the videos are their own and/or that they own their copyrights. In the case of videos with others, they declare that they have their permission to publish and display all their images.
8.3. ENTRANTS assume full responsibility for all third-party claims, including, but not limited to, third-party image and copyright claims relating to the posted material. The SPONSOR is entitled to pass incoming claims and complaints they receive as a result of that material onto the ENTRANTS.
8.4. ENTRANTS, upon registration, authorize the disclosure of their names and respective photos, as well as the free use of their images and voices in photos, posters, films, and/or spots, jingles and/or vignettes, in any kind of media, promotional items, and online campaigns, for the disclosure of this CONTEST, for a period of 2 (two) years from its start date, without being entitled to any payment for such use. This authorization does not imply any obligation for the SPONSOR to publish any material, and the ENTRANTS agree to sign any receipts and instruments to that effect, if necessary.
8.5. These rules clearly express, and all ENTRANTS agree, that, in view of the inherent characteristics of the Internet environment, the SPONSOR cannot guarantee that access to the application will be free of interruptions, invasions or suspensions, and lack of energy, especially in case of force majeure or fortuities.
8.6. Any questions not foreseen in this regulation, or any questions that may arise, will be judged by the SPONSOR, whose decisions are final and not open to appeals.
8.7. The SPONSOR, at any given time and at its own discretion, may undertake any preventive or corrective action to maintain the proper running of any technological tool related to the CONTEST, which is why the ENTRANTS are hereby exempt from any liability whatsoever as a result of any impossibility to participate in the CONTEST arising from such acts
8.8. The SPONSOR disclaims any liability arising from the misuse by third parties of any image published in the CONTEST, including its reproduction and/or dissemination on Internet sites such as YouTube, Facebook, Instagram, Twitter, or even blogs, websites, and virtual communities of this nature. The ENTRANT acknowledges and agrees that data and materials posted directly on the chosen social media will be subject to such media interactions, including by other users.
8.9. Participating in this CONTEST implies complete acceptance of these General Rules.
8.10. These rules will be available at 30days4free.visitbrasil.com for the duration of the CONTEST.
8.11. EMBRATUR will assure the candidates the opportunity to appeal regarding the disqualification of their videos or of any entrants, and regarding the published result, within 05 (five) days of the act. Appellants must forward their grounds for appeal to the following email address: firstname.lastname@example.org.
8.11.1. The appeal will not be accepted if not presented in conjunction with its reasons or if presented after the deadline set in the previous item.
8.11.2. The appeal will not have any suspensive effect, and its acceptance will invalidate only those acts that cannot be exploited.
8.11.3. Upon receipt of the appeal, and if the Judging Committee does not retract, the decision will be issued by the President of EMBRATUR within five (5) business days starting at the end of the appeal period.
8.12. The Federal Court of Justice, in the Judicial Section of the Federal District, is hereby elected, excluding any other Forum, privileged as it may be, to settle any issues arising from this notice and these general regulations.
